This Privacy Policy describes how we collect, use, disclose, and safeguard information when you visit byrybicki.com (the “Site”) or interact with our services.

Automatically Collected Information

When you visit the Site, we and our service providers may automatically collect certain technical information, including:

  • Pages viewed and time spent on each page

This information is collected through Vercel Analytics using a privacy-first approach. It is aggregated and does not include personally identifiable information. Individual visit data is not retained beyond 90 days.

Information We Do Not Collect

We will not use your information for any purpose materially different from those described above without your explicit consent. We will never sell, rent, or trade your personal information to third parties for their marketing purposes.

Legal Basis (where applicable): We process your personal information on the basis of (a) your consent when you submit a form, (b) contractual necessity when providing requested real estate services, (c) legitimate interests in operating our business and communicating with prospective clients, and (d) compliance with legal obligations.

Who We Share With

We share your personal information only with service providers who are necessary to operate our business and deliver the services you have requested. We do not share your data with advertising networks, data brokers, or third-party marketers.

  • Keller Williams Arizona Realty (GO BIG, LLC): Our licensed brokerage, for transaction-related communications, compliance requirements, and mandatory brokerage record-keeping
  • Resend: Email delivery service used to transmit form notification emails to us. Your email address and form content pass through Resend's servers for delivery only
  • Vercel: Website hosting provider. Vercel Analytics processes anonymized, aggregate-only traffic data. No personally identifiable information is stored in Vercel Analytics
  • Upstash: Serverless database provider for storing lead records and market update data. Data is encrypted at rest and in transit
  • Microsoft Clarity: Session recording and behavioral analytics provider. Microsoft Clarity uses first and third-party cookies to collect heatmap and session replay data. This data is shared with Microsoft and used to understand how visitors use this Site. For more information, visit the Microsoft Privacy Statement.
  • Legal authorities and law enforcement: When required by valid legal process (subpoena, court order, or applicable law), or when necessary to protect our legal rights, prevent fraud, or protect the safety of any person
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred. We will notify you before your personal information becomes subject to a materially different privacy policy

All third-party service providers are subject to data processing agreements requiring them to handle your information securely and only for the purposes we specify. We conduct reasonable due diligence on service providers before engaging them.

Your Rights

Depending on your location and applicable law, you may have the following rights regarding your personal information:

  • Right to Access: Request a copy of the personal information we hold about you
  • Right to Correction: Request correction of inaccurate or incomplete personal information

To exercise any of these rights, contact us at info@byrybicki.com with the subject line “Privacy Rights Request” and identify the right you wish to exercise. We will respond within 10 business days. We may request verification of your identity before processing your request.

We will not deny services, charge different prices, or provide a lower level of service because you exercised your privacy rights.

Data Retention

We retain personal information only as long as necessary for the purposes for which it was collected, to provide our services, and to comply with our legal obligations.

  • Lead and inquiry records: Retained for 3 years from the date of initial submission, or until you request deletion, whichever is earlier
  • Active client records: Retained for the duration of any active engagement plus 5 years, as required by Arizona real estate brokerage regulations
  • Email communications: Retained for as long as relevant to an active or prospective client relationship, typically 3 years
  • Analytics data: Rolling 90-day retention. No personally identifiable information is stored
  • Cookie consent preference: Stored locally in your browser's localStorage until cleared

After applicable retention periods, data is securely deleted or anonymized. Certain records may be retained longer when required by law, regulation, or valid legal process. You may request deletion of your data at any time at info@byrybicki.com; we will process deletion requests within 30 days except where retention is legally required.

Security

We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, use, alteration, or destruction. These include:

  • HTTPS/TLS encryption for all data transmitted to and from this Site
  • Encryption at rest for data stored in our database systems
  • Access controls limiting who can view stored personal information
  • Use of reputable, security-focused service providers

No method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your personal information using commercially acceptable means, we cannot guarantee absolute security. We are not responsible for the actions of hackers, third parties, or other unauthorized actors who circumvent security measures.

Data Breach Notification: In the event of a data breach that reasonably affects your rights and freedoms, we will notify affected individuals and applicable regulatory authorities in accordance with applicable law. Notifications will be provided without undue delay.

Cookies & Tracking Technologies

We use cookies and similar technologies (localStorage, session storage) to operate and improve the Site.

  • Analytics cookies (Vercel Analytics): Collect aggregate, anonymized data about how visitors use the Site — page views, navigation paths, and device types. No personal data is stored. Only activated after consent.

Session Recording & Analytics (Microsoft Clarity)

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with this website through behavioral metrics, heatmaps, and session replay to improve and market our products and services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of content and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising.

This Privacy Policy applies solely to information collected by byrybicki.com. It does not apply to information you provide directly to third-party platforms such as Keller Williams, Facebook, Google, or any other external service.

Children's Privacy

This Site is not directed to, and we do not knowingly collect personal information from, children under 13 years of age. Use of this Site by persons under 18 is not permitted without parental or guardian consent, and real estate services are available only to adults.

If you are a parent or guardian and believe that your child under 13 has provided us with personal information without your consent, please contact us immediately at info@byrybicki.com. We will take steps to promptly delete such information from our records.

We comply with the Children's Online Privacy Protection Act (COPPA) and will not knowingly collect, use, or disclose personal information from children under 13.

Do Not Track

Some browsers include a “Do Not Track” (DNT) feature that sends a signal to websites requesting that your browsing activity not be tracked. Because there is no universally accepted standard for what DNT signals mean or how to respond to them, this Site does not currently respond to DNT browser signals.

European Users (GDPR)

If you are located in the European Union, European Economic Area, or United Kingdom, you have rights under the General Data Protection Regulation (GDPR) or UK GDPR, including rights to access, rectification, erasure, restriction of processing, data portability, and objection.

Data Transfers: This Site is operated from the United States.
