Matthew Rybicki PLLC, doing business as "By Rybicki" (the “Company,” “we,” “us,” or “our”), and operating in affiliation with Keller Williams Arizona Realty, is committed to protecting your privacy. This Privacy Policy explains how we collect, use, share, and safeguard your personal information when you use our website and services. It also describes your rights and choices regarding your personal information. This Policy applies to all visitors and users of our website, including U.S. residents (with specific notices for California and EU residents as noted). By using our site or providing information to us, you agree to the terms of this Privacy Policy. If you do not agree, please do not use our site.

Note: Our website is intended for a general audience and not directed to children under 13. We do not knowingly collect personal information from children under 13 years of age. If we learn that we have collected information from a child under 13, we will delete it.

We are committed to compliance with all applicable Fair Housing laws. We do not collect or use information in a manner that would violate Fair Housing laws or discriminate on the basis of any protected class.

Information We Collect

We collect personal information that you choose to provide to us, as well as certain information automatically collected when you use our site. We do not require account registration to browse our site; you can use the site without logging in. The types of information we collect are:

Information You Provide Directly: When you fill out forms on our site (such as contact forms, requests for a Comparative Market Analysis (CMA), or other inquiry forms), we collect personal information you provide. This may include your name, email address, phone number, and information about your real estate interests or property preferences (for example, property type, location, price range, and any additional information you choose to submit in a message). If you contact us directly (such as via email, phone, or in person), we will receive whatever information you choose to share during the communication.

Lead Information from Third-Party Platforms: We may also receive personal information about you from lead-generation forms on third-party platforms. For example, if you submit your contact information through Facebook Lead Ads or Google Ads Lead Forms to inquire about our services or listings, those platforms will send us your submitted information (such as your name, contact details, and inquiry details). We treat information received from these sources in accordance with this Privacy Policy.

Information Collected Automatically: When you visit our website, we and our third-party partners automatically collect certain information about your device and usage of the site. This includes data such as your IP address, browser type, device type, operating system, referring URLs, pages viewed, and the dates/times of access. We collect this information through cookies, pixels, and similar tracking technologies (described more below). This usage data helps us understand how visitors use our site and ensure it functions properly across different devices and browsers. It may also include approximate geolocation data inferred from your IP address (e.g. city or region level location).

We do not knowingly collect any sensitive personal information such as Social Security numbers, driver’s license or financial account numbers through our website. We also do not intentionally collect any information about your race, ethnicity, health, or other special categories of data through the site. We do not collect any payment or financial information via the website – our site does not sell products or services online, and clients who engage our real estate services will handle any commission payments offline through separate agreements.

How We Use Your Information

We use the personal information we collect for the following purposes, in each case in a lawful and responsible manner:

Providing and Improving Services: We use your information to respond to your inquiries and requests, such as contacting you if you ask for information about a property or request a home valuation (CMA). We may use your contact information to get in touch and discuss your real estate needs, schedule showings, or provide services you requested. Internally, we also use the information to improve our services and website – for example, analyzing usage data helps us troubleshoot issues and optimize user experience.

Communication and Updates: We use your email address and/or phone number to communicate with you. This can include sending you transactional messages (such as responding to a message you sent through a form, or confirming details of a request) as well as marketing communications about real estate listings, market updates, or our services if you have opted to receive them. (See SMS and Email Communications below for how we obtain consent and how you can opt out of marketing messages.)

Marketing and Remarketing: We may use the information about your visits and interactions on our site to deliver relevant advertising. For example, if you visit our site, you might later see advertisements for our services on other websites or social media platforms. This is done through cookies and pixels (like the Facebook Pixel and Google Ads, described in Cookies and Tracking Technologies below) that help us show you targeted ads.

Analytics and Site Performance: We use analytics tools to understand how users find and use our website, which pages are popular, and other usage patterns. This information helps us measure the effectiveness of our marketing and make improvements to our website content, navigation, and features.

Legal and Compliance: We may use or retain your information as necessary to comply with applicable laws and regulations (for example, real estate record-keeping requirements), to respond to lawful requests and legal process, or to enforce our agreements. We also may use information to detect and prevent fraud, security incidents, or other malicious activity that could compromise our website or our users. We comply with all applicable and federal laws regarding the privacy and confidentiality of real estate client information.

We will only use your personal information for the purposes outlined above or as otherwise disclosed at the time of collection. If we need to use your information for an unrelated purpose, we will notify you or seek your consent as required by law.

Cookies and Tracking Technologies

Our website uses cookies and similar tracking technologies (such as pixels and web beacons) to provide and improve our services, analyze usage, and deliver personalized ads. A cookie is a small text file that is stored on your device when you visit a website. We use the following types of cookies and trackers on our site:

Essential Cookies: These are necessary for the website to function correctly. For example, they may enable basic site features or security measures. Without these, the site may not operate properly.

Analytics Cookies: We use analytics tools like Google Analytics to collect information about how visitors use our site. Advertising and Remarketing Cookies/Pixels: We partner with third-party advertising networks (such as Google Ads and Facebook/Meta) to display ads to you on other platforms after you’ve visited our site. These partners use cookies or similar technologies (like the Google Ads cookies and the Meta Pixel) to collect information about your activities on our site and other sites, in order to show you ads that are tailored to your interests. For example, the Meta Pixel on our site sends certain information about your visit to Facebook (Meta), which can help us display a follow-up ad on Facebook or Instagram. Similarly, we use Google’s advertising cookies to serve you ads on websites in Google’s advertising network. These tracking technologies may collect device identifiers and information about your browsing behavior. For more details, see Google’s Privacy Policy and Facebook’s Privacy Policy.

Follow Up Boss Pixel: Our site also uses a tracking pixel provided by Follow Up Boss, which is the customer relationship management (CRM) platform we use to manage leads and client communications. The Follow Up Boss pixel helps us track when you visit our site or take certain actions (like submitting a form), and it syncs that information with our CRM so we can follow up with you effectively. You can learn more from the Follow Up Boss Privacy Policy.

Your Choices (Cookies): When you first visit our site, you may see a cookie notice (if applicable) or you can adjust your browser settings to refuse non-essential cookies. Most web browsers automatically accept cookies, but you can modify your browser setting to decline or delete cookies if you prefer. Please note that blocking all cookies may impact your experience on our site, and certain features may not work as intended without cookies. Additionally, you can opt out of targeted advertising from certain networks: for example, to opt out of Google’s personalized ads, visit the Google Ads Settings; to opt out of Facebook’s interest-based ads, adjust your ad preferences on your Facebook account. You can also visit the Network Advertising Initiative’s opt-out page or the DAA’s WebChoices tool to opt out of many ad networks’ tracking. Keep in mind, opting out of advertising cookies does not mean you will stop seeing ads, but those ads may be less relevant to your interests.

Do third parties collect data on our site? Yes. As noted above, third-party analytics and advertising partners (like Google, Facebook/Meta, and Follow Up Boss) collect certain information via cookies and trackers on our site. This means your online activities on our site (and possibly across other sites) may be collected over time by these third parties. Their use of your data is governed by their respective privacy policies. We do not have direct control over the information collected by these third-party technologies, but we allow it in order to improve our services and advertising. You can opt out of or block these trackers as described in this section.

SMS and Email Communications

Opt-In Consent: By providing your email address or phone number to us (for example, by filling out a contact form and checking any applicable consent box, or by otherwise requesting information), you are opting in to receive communications from us. This may include marketing emails, newsletters, or text messages about real estate opportunities, as well as transactional or informational messages related to your inquiries. We obtain your consent for email marketing in compliance with laws like CAN-SPAM, and for text messages in compliance with the Telephone Consumer Protection Act (TCPA) and other applicable laws. We will not send you promotional text messages unless you have agreed to receive them. If you provide a phone number, you may receive text messages from our Company’s number; these might be sent through our CRM’s texting platform (Follow Up Boss) or occasionally via our business mobile phone.

Content and Frequency: Communications via email or SMS will relate to our real estate services. For example, if you requested a CMA or showed interest in a listing, we might email or text you updates such as new listings, market insights, or follow-up messages to assist with your real estate needs. We aim to keep our communications relevant and reasonable in frequency. Standard message and data rates may apply to any text messages we send, depending on your phone plan.

Opt-Out/Unsubscribe: You have the right to opt out of marketing communications at any time. To opt out of text messages, simply reply “STOP” to any SMS we send. Once we receive a STOP request, we will confirm your opt-out and you will no longer receive text messages from us (unless you subsequently opt in again). To opt out of marketing emails, you can click the “unsubscribe” link provided at the bottom of any promotional email, or contact us at any time requesting removal from our email list. Please note that even if you opt out of marketing messages, we may still send you essential transactional or service-related communications (for example, a direct response to a specific inquiry you sent, or information about an ongoing transaction or contract you have with us).

No Third-Party Marketing: We do not sell or share your contact information (including phone numbers or email addresses) with unaffiliated third-party marketers for their own promotional purposes. In other words, if you provide your phone number to us, we will not give or sell it to outside telemarketers or spammers. Your phone number and email may be stored in our secure CRM and email systems (such as Follow Up Boss and Mailchimp) to facilitate our communications with you, but these service providers are contractually prohibited from using your information for their own marketing.

How We Share Your Information

We understand the importance of your personal information and only share it in certain circumstances, primarily to operate our business and comply with the law. The categories of third parties with whom we may share your information are:

Service Providers: We share personal information with trusted third-party service providers who perform services on our behalf and under our instructions. These include:

Customer Relationship Management (CRM) Platforms: We use CRM tools like Follow Up Boss (and the Keller Williams internal CRM system known as Command) to store lead information, track communications, and manage our client relationships. When you submit a form or otherwise provide your information, it may be entered into these systems. These providers process your data solely to help us organize contacts and communicate with you. (See Follow Up Boss’s Privacy Policy for information on their data practices.)

Email Marketing and Newsletter Services: If you subscribe to our newsletter or we send emails to clients and leads, we may use an email service provider such as Mailchimp (provided by Intuit) or the email tools within Follow Up Boss. Your email address and name may be stored on these platforms for the purpose of sending you emails. See the Intuit Global Privacy Statement (which covers Mailchimp) for details on their handling of data.

Communication Tools and Scheduling: We may use tools to facilitate calls, texts, or appointment scheduling. For example, our phone system (which might be integrated with Follow Up Boss or our business mobile carrier) will process your phone number when we call or text you. If we use any online scheduling service or chat tool (aside from the mentioned platforms), those would similarly handle any info you provide to schedule meetings or chat. (Note: We do not currently use chatbots or live chat widgets on the site, so any communication is via the channels described.)

Electronic Signature and Document Services: If you engage our services as a client, we might use services like DocuSign or other electronic signature platforms to send or receive signed documents (for example, listing agreements, purchase contracts, etc.). If so, your name, email, and any signatures or form inputs will be processed by that platform. Those services are used only as needed for transactions and have their own privacy and security policies.

Analytics and Advertising Partners: As described in the Cookies and Tracking section, we allow certain third-party analytics and advertising providers (like Google and Meta/Facebook) to collect information via cookies/pixels on our site. This means we indirectly “share” some data (related to your device and browsing actions) with these partners to enable analytics and personalized ads. However, this data is typically in the form of online identifiers and browsing information; we do not manually send them your name or contact information. These partners act as independent controllers of the data they collect via their trackers.

OpenAI (ChatGPT) for Content Creation: We sometimes use AI tools such as OpenAI’s ChatGPT for content creation and assistance in our business communications (for example, drafting marketing content or summarizing information). While we primarily use these tools for general content, on occasion they might process snippets of information that relate to our business operations or client interactions. We do not knowingly feed any personal details like your name or contact info into public AI tools without consent; however, it’s possible that some context from user inquiries or messages (which could include personal information you provided) might be processed by these AI services as we use them to improve our responses or marketing content. We use such tools responsibly and in accordance with their terms, and we treat any output as confidential within our company. (OpenAI’s systems have their own usage policies and may store data provided to them for model improvement, so we are cautious about what data is input.)

Brokerage and Affiliates: Matthew Rybicki PLLC is affiliated with Keller Williams Arizona Realty as our brokerage. We may share your information internally within our brokerage as needed to facilitate real estate transactions and services. For example, if you become a client, your transaction details and contact information might be shared with our brokerage’s transaction management system or staff (for compliance, broker oversight, or coordination purposes). The brokerage is committed to maintaining confidentiality of client information as required by law and professional standards. We do not disseminate your personal information across the brokerage for any purpose unrelated to your specific real estate transaction or inquiry.

Legal Requirements and Protection: We may disclose personal information if required to do so by law or legal process, for example in response to a subpoena, court order, or regulatory demand. We may also share information if we believe, in good faith, that such disclosure is necessary to investigate or protect against harm to our rights, property or safety, or those of our clients, users, or the public. This includes exchanging information with other companies and organizations for fraud protection or to address security or technical issues.

Business Transfers: In the unlikely event that our company undergoes a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, personal information we have collected may be transferred as part of that transaction. If such a transfer occurs, we will ensure that your information remains protected by appropriate confidentiality obligations, and we will notify you (for example, via a notice on our website or email) of any change in data ownership or use, as required by law.

No Selling of Personal Information: We do not sell your personal information for monetary compensation. In addition, we do not share your personal information with third parties for their own independent marketing purposes. For example, we do not give or sell lead lists or your phone number to unrelated companies so they can market to you. Any sharing of data is only done as described above (either with service providers under contract, within our brokerage as needed, or with third-party tools you interact with). If in the future we anticipate selling personal information, we would update this Privacy Policy and provide any required notices or opt-out mechanisms under applicable laws. (See California Privacy Rights below for more on “Do Not Sell or Share” requests under California law.)

California Privacy Rights

If you are a resident of California, you have specific privacy rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). In this section, “personal information” has the meaning given in the CCPA/CPRA. Even if these laws do not strictly apply to our business (for example, if we do not meet certain thresholds), we value your privacy and provide you with the following rights and disclosures:

Categories of Personal Information Collected: In the past 12 months, we have collected the following categories of personal information from California consumers, corresponding to the examples provided in the law:

Identifiers: e.g., real name, email address, phone number, and IP address.

Personal Information Categories Listed in Cal. Civ. Code §1798.80(e): This overlaps with identifiers (such as contact information). We do not collect types of data like Social Security number, driver’s license, or financial account information via the website.

Internet or Other Electronic Network Activity: e.g., browsing history, clickstream data, and interactions with our website or advertisements (through cookies and pixels, we gather information on how you navigate and use our site).

Geolocation Data: We do not actively collect precise GPS location, but we may infer general location (city/region) from your IP address as part of analytics data.

Professional or Employment Information: We do not request or collect your employment information or professional background through our site. (If you voluntarily provided such info in a message, it could be contained in our records, but we do not solicit it.)

Inferences: We may draw inferences about your preferences (for example, inferring your property preferences from the information you provide or your browsing behavior on our site) to personalize your experience or tailor our communications with you.

Categories of Sources: We collect personal information directly from you (e.g., when you fill out a form or communicate with us) and automatically from your devices (through cookies and tracking on our website). We also obtain personal information from third-party sources such as Facebook or Google lead forms when you have provided it there, as well as from our advertising/analytics partners via tracking technologies.

Business or Commercial Purposes for Collection: We collect and use personal information for the purposes described in the How We Use Your Information section of this Policy. These purposes include providing services (real estate brokerage services and related communications), responding to inquiries, marketing our services, analyzing and improving our website, and ensuring legal compliance and security.

Disclosure of Personal Information: In the preceding 12 months, we have disclosed the above categories of personal information to third parties for our business purposes. Specifically, contact information and inquiry details have been shared with our service providers (such as our CRM, email service, and brokerage systems) in order to serve you. Internet and network activity data (like cookie information) has been shared with third-party analytics and advertising partners (e.g., Google, Facebook) to enable those services. We do not disclose personal information to unrelated third parties for their own independent use.

Sale or Sharing of Personal Information: Under CCPA/CPRA, a “sale” includes selling or renting personal data for money, and “sharing” refers to disclosing it for cross-context behavioral advertising. We do not sell personal information for monetary value. We also do not share California consumers’ personal information with third parties for their own cross-context behavioral advertising without consent. The only “sharing” that may occur is via third-party cookies/pixels for advertising as described in the Cookies and Tracking section. However, we treat this as a permitted business purpose with your implied consent when you use our site (and you can opt out of those trackers as described). If you are a California resident and believe this kind of data transfer constitutes a “sharing” of your personal information that you want to opt out of, you have the right to direct us to stop. To exercise an opt-out of sale or sharing, you may contact us as described below, and we will honor your request by disabling non-essential tracking for your visit and/or through instructing our advertising partners as feasible. We do not have actual knowledge of selling or sharing personal information of consumers under 16 years of age.

Your California Privacy Rights: California law provides you (as a California consumer) with the following rights regarding your personal information:

Right to Know: You have the right to request that we disclose what personal information we have collected about you in the past 12 months, including the specific pieces of information, the categories of information, the categories of sources, the business purposes for collection, and the categories of third parties with whom we shared your information.

Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, if we are legally required to keep certain records, or if the information is needed to complete a transaction you requested).

Right to Correct: You have the right to request that we correct inaccurate personal information that we maintain about you.

Right to Opt-Out of Sale or Sharing: You have the right to opt out of the sale of your personal information, or sharing of your personal information for cross-context behavioral advertising purposes. As noted, we do not sell personal data. If we engage in any practices that qualify as “sharing” for targeted advertising, you can opt out as described above.

Right to Limit Use of Sensitive Personal Information: You have the right to limit our use or disclosure of sensitive personal information, if we collected any. (Note: We do not collect sensitive personal data such as social security numbers, financial account info, or precise geolocation via our site. In the event we ever did, those uses would be only for necessary purposes and you would have the right to restrict secondary uses.)

Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means we will not deny you services, charge you different prices, or provide a different level of service because you exercised your rights. However, please note that if you request deletion of certain data, it may impact our ability to assist you (for instance, if you ask us to delete your contact information, we would no longer be able to reach out regarding a inquiry unless you provide it again).

Exercising Your California Rights: To make a request to access, delete, or correct your personal information, or to opt out of sale/sharing, please contact us using one of the methods listed in the Contact Us section of this Policy. Please state that you are a California resident making a “CCPA/CPRA request” and clearly describe the nature of your request. We will need to verify your identity before fulfilling certain requests to ensure we protect your information from unauthorized access. For verification, we may ask you to provide additional information to match against our records (for example, confirming your email address or phone number that we have on file). You may also designate an authorized agent to make a request on your behalf. If you do so, we will require the authorized agent to provide proof of your permission and may still ask you to verify your identity directly.

For “Do Not Sell or Share” requests, you may also utilize any automated opt-out mechanisms we provide (if applicable on our website) or send us an email indicating your preference to opt out of data selling/sharing. Since we do not sell data, and only use limited advertising cookies, typically your choices with our cookie management or contacting us will suffice. We will respond to California consumer requests within the timeframes required by law (generally within 45 days, with the possibility of a 45-day extension, which we will communicate to you if needed).

Lastly, California’s “Shine the Light” law (Civil Code § 1798.83) allows California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for their own direct marketing, so we believe we have no such disclosures to provide. However, if you have questions about our practices in this context, you may contact us.

European Union (GDPR) Privacy Rights

While our services are primarily targeted to residents of the United States, particularly Arizona, we recognize that our website may be accessible to individuals in the European Union (EU), United Kingdom (UK), or other regions that have comprehensive data protection laws. If you are an individual in the EU/EEA, UK, or another jurisdiction with similar laws, you are entitled to certain rights and information under the EU General Data Protection Regulation (GDPR) or applicable local law.

Legal Bases for Processing: We only process your personal information when we have a legal basis to do so under the GDPR. The legal bases we rely on are:

Consent (GDPR Article 6(1)(a)): In some cases, we rely on your consent to process your personal data. For example, we will obtain your consent before sending you marketing emails or texts (where required by law) and before using certain cookies or tracking technologies on our site (in EU jurisdictions that require cookie consent). You have the right to withdraw your consent at any time.

Performance of a Contract (Article 6(1)(b)): If you request our real estate services or information, certain processing of your data may be necessary to take steps at your request before entering into a contract or to fulfill our obligations to you under an agreement. For instance, if you ask for our help in buying or selling a property, we will use your contact and preference information to provide the requested service and communicate with you – this is considered processing necessary for the performance of a contract (the brokerage agreement or the steps leading to one).

Legitimate Interests (Article 6(1)(f)): We may process personal information as necessary for our legitimate interests, provided those interests are not overridden by your data protection rights. Our legitimate interests include: communicating with and marketing to our clients and prospective clients (such as sending relevant real estate updates, subject to appropriate consent for electronic communications), improving and securing our website (e.g., through analytics and troubleshooting), and operating our business efficiently. When we rely on legitimate interests, we will consider any potential impact on you and your rights, and we will not use your data for activities where our interests are outweighed by the harm to your privacy. You have the right to object to processing based on our legitimate interests in certain cases (see “Your GDPR Rights” below).

Legal Obligation (Article 6(1)(c)): We may need to process and retain some personal information to comply with our legal obligations. For example, as real estate professionals we may be subject to laws requiring record-keeping of transactions, or to comply with tax and accounting rules, or to respond to lawful requests by public authorities. If such laws apply, they constitute a legal basis for processing.

International Data Transfer: If you are accessing our services from outside the United States (such as from the EU/EEA or UK), please be aware that your personal information will be transferred to and processed in the United States. Our Company is based in Arizona, USA, and the web servers and databases for our website (and those of our service providers like Follow Up Boss, Mailchimp, etc.) are likely located in the U.S. or other countries outside your home jurisdiction. The data protection laws in these countries may not be as strict as those in your country. We will however take appropriate measures to ensure that your personal data remains protected in accordance with applicable law. This may include relying on European Commission-approved Standard Contractual Clauses for data transfers, or other appropriate safeguards. By using our site and providing information to us, you acknowledge that your data will be transferred to the U.S. and processed there as necessary to provide you with the requested services/information.

Your GDPR Rights: If you are in the EU/EEA or UK, you have the following rights regarding your personal data (subject to certain limitations and exceptions under law):

Right of Access: You have the right to request confirmation of whether we are processing your personal data, and if so, to request a copy of the data and additional details about how we use it.

Right of Rectification: You have the right to request that we correct or update any inaccurate or incomplete personal data we hold about you.

Right to Erasure: You have the right to request that we delete your personal data, in certain circumstances. This is sometimes called the “right to be forgotten.” We will honor such requests to the extent we are legally able to do so. For example, we may need to retain certain information for legal compliance or legitimate business purposes (if lawful under GDPR).

Right to Restrict Processing: You have the right to request that we limit the processing of your personal data in certain situations (for instance, while we are addressing a concern about the accuracy of your data or lawfulness of processing).

Right to Data Portability: Where you have provided data to us and the processing is carried out by automated means based on your consent or a contract, you have the right to request a copy of your personal data in a structured, commonly used, machine-readable format, and to have that information transmitted to another controller when technically feasible.

Right to Object: You have the right to object to our processing of your personal data when we base it on legitimate interests, including any profiling based on those interests. You also have the right to object at any time to processing of your personal data for direct marketing purposes. If you object, we will consider whether we have any compelling legitimate grounds to continue processing (or in the case of direct marketing, we will simply stop).

Right to Withdraw Consent: If we rely on your consent for any processing, you have the right to withdraw that consent at any time. This will not affect the lawfulness of any processing that occurred before your withdrawal. For example, you can withdraw consent to marketing emails by unsubscribing, or withdraw consent to cookies by adjusting your preferences or using the opt-outs we described earlier.
